Terms of Service

1. Acceptance of Terms

By accessing or using JoGo.Team, you agree to be bound by these Terms, our Privacy Policy, and the JoGo.Team Waiver. If you do not agree, you must not use the site or participate in any listed activity.

2. Nature of the Platform

JoGo.Team is a digital listing and communication service for independently-organized recreational soccer activities. We do not organize, supervise, manage, operate, staff, coach, referee, or otherwise control any games or events listed on the site.

All games are run by independent hosts ("Hosts"), who are not employees, agents, partners, or representatives of JoGo.Team. Listings are not endorsements; JoGo.Team makes no representations or warranties about any Host, participant, venue, or activity. Participation is entirely at your own risk and subject to the JoGo.Team Waiver.

3. Eligibility and Use of the Site

You must be at least 18 years old to create an account or RSVP for a listed activity. Minors may only participate under a separate paper waiver signed by a parent or legal guardian and collected by the Host (see Waiver Section 9). The site is intended for personal, non-commercial use except as expressly authorized.

4. Intellectual Property

The content on JoGo.Team, including text, graphics, logos, and images, is the property of JoGo.Team or its licensors and is protected by copyright and intellectual-property laws.

5. User Conduct

You agree to use the site respectfully and to obey all applicable laws and Host or venue rules. Harassment, threats, hate speech, fraud, doxxing, or any other disruptive or unlawful behavior is strictly prohibited and may result in immediate account termination.

A listing must be a genuine offer to join through the Platform. Directing players to sign up, reserve a place, or be added to a roster elsewhere - including in a profile or game description - is not permitted.

6. User Contributions

Any content you submit (comments, reviews, photos, etc.) must not infringe any third-party rights and must comply with applicable copyright, privacy, defamation, and right-of-publicity laws. By submitting content, you grant JoGo.Team a non-exclusive, royalty-free, worldwide license to host, display, and distribute it through the Platform.

7. Payments and Transactions

a. Payment Processing

Payments are processed through Stripe and Stripe Connect. By making a payment, you agree that:

• JoGo.Team does not store complete credit card information.
• Stripe processes your payments according to Stripe's own terms and policies.
• You are responsible for providing accurate and valid payment information.
• Payments are final once processed, subject to the refund terms in Section 10.

b. Booking Fee

JoGo.Team charges a booking fee on each paid reservation. The fee is added to the player's payment at checkout and is paid by the player: the Host receives the full price they set for the game. The fee covers card processing and the JoGo.Team platform, and follows our published fee structure.

c. Stripe Connect for Hosts

Hosts who wish to receive payments must:

• Create and maintain a Stripe Connect account.
• Complete the verification process required by Stripe.
• Comply with Stripe's terms of service.
• Understand that payments are transferred directly to their Stripe Connect account.
• Acknowledge that JoGo.Team is not responsible for issues with Stripe Connect accounts.

8. JoGo Wallet

a. Wallet Usage

The JoGo Wallet allows you to store prepaid funds for future game payments:

• Top-ups are processed through Stripe Checkout.
• Wallet funds do not accrue interest.
• Wallet funds are intended solely for payments to listed games on the Platform.
• You may not transfer wallet funds to other users.

b. Limitations

JoGo.Team is not a bank or financial institution. The wallet is a prepaid balance and is not insured by the FDIC or any other government agency. Wallet balances may be subject to your state's unclaimed-property (escheat) laws after extended inactivity.

9. Jogxz Tokens

Jogxz Tokens are non-monetary engagement rewards. They have no cash value, cannot be converted to money, are not transferable, are the property of JoGo.Team, and are awarded at our discretion. Tokens do not currently expire but may be modified, suspended, or revoked at any time, including for fraud, abuse, or violation of these Terms. Future token benefits, if any, will be announced on the Platform; no specific benefit is guaranteed.

10. Refunds and Cancellations

By default, all cancellations — whether initiated by you or by the Host — are credited to your JoGo Wallet, regardless of the original payment method. JoGo Wallet credits do not expire and can be used on any future game on JoGo.Team. No-shows do not receive credit.

Hosts may, at their discretion and on a per-event basis, issue a refund to the original payment method via Stripe. JoGo.Team does not guarantee that a payment-method refund will be offered; the default and contractual remedy is a JoGo Wallet credit. Each Host may set their own refund policy. For any cash or payment-method refund request, contact your game Host directly.

11. Host Responsibilities

Every Host is responsible for using the Platform as the way players join their games. Hosts may show contact links on their profile, including a WhatsApp group invite, but must not present messaging, a group, or any other channel as the way to sign up for a game or secure a place. Places on a roster are claimed through the Platform; groups and contact links are for coordinating with players who have already joined.

Hosts using Stripe Connect are responsible for:

• Maintaining accurate information in their Stripe Connect account.
• Complying with all applicable laws, regulations, taxes, and venue rules.
• Providing services as described in their listings.
• Managing disputes with players directly when appropriate.
• Collecting any required guardian waivers for minors before the activity begins.
• Understanding that JoGo.Team is not responsible for the conduct of the Host, participants, venue staff, or any third party at any listed activity.

12. Electronic Communications Consent (SMS, WhatsApp, Email)

By creating a JoGo.Team account, providing your phone number, or RSVPing to a listed activity, you expressly consent to receive transactional and informational communications from JoGo.Team and the Host of any activity you join, including via email, SMS text message, and WhatsApp. These communications may include game confirmations, waitlist updates, cancellations, refund notices, reminders, and account or safety alerts.

Message and data rates may apply. Message frequency varies by activity. You may opt out of SMS messages by replying STOP, opt out of WhatsApp messages by replying STOP or blocking the sender, and unsubscribe from marketing emails through the unsubscribe link in those emails. Transactional messages necessary to complete a transaction you have initiated may continue after opt-out. Consent to receive automated messages is not a condition of purchase except for transactional messages directly related to a game you have RSVPed for.

13. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, uninterrupted operation, or freedom from harmful components. JoGo.Team does not warrant any Host, venue, participant, or activity.

14. Limitation of Liability

To the maximum extent permitted by law, JoGo.Team and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, personal injury, or property damage, arising out of or related to your use of the Platform, including:

• Damages arising from the use or inability to use the site or services.
• Third-party payment-processing issues (including Stripe and Stripe Connect).
• Loss of wallet funds due to unauthorized account activity.
• Disputes between Hosts and players.
• Injuries, illness, communicable disease, or damages during events organized by Hosts.

JoGo.Team's aggregate liability arising out of or related to the Platform shall not exceed the greater of (a) the total amount you paid to JoGo.Team in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

15. Indemnification

You agree to indemnify, defend, and hold harmless JoGo.Team, its owners, employees, contractors, affiliates, Hosts, and venue operators from any claim, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising from your use of the site, your participation in any listed activity, your violation of these Terms, your violation of any third-party right, or your violation of any applicable law.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Platform after an update constitutes acceptance of the updated Terms.

17. Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent or harmful activity, fail to pay amounts owed, or for any other reason at our discretion. On termination, you may lose access to wallet funds and Jogxz Tokens, subject to applicable law and any required escheatment of unclaimed balances.

You may delete your account at any time from Profile → Settings → Delete my account, or by contacting us. We will confirm your request by email and, after a 30-day grace period during which logging back in cancels the request, permanently delete or de-identify your personal information as described in our Privacy Policy and on our Data Deletion page. Deleting your account does not entitle you to a refund of any non-refundable amounts, does not cancel obligations you incurred before deletion, and may result in the forfeiture of any wallet balance or Jogxz Tokens to the extent permitted by applicable law. We may retain de-identified, aggregated, and legally required records after deletion as set out in our Privacy Policy.

Sections of these Terms that by their nature should survive termination — including Payments, Disclaimer of Warranties, Limitation of Liability, Indemnification, Binding Arbitration and Class-Action Waiver, Governing Law, and Severability and Survival — will survive the termination or deletion of your account.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Subject to Section 19 (arbitration), any non-arbitrable dispute shall be brought exclusively in the state or federal courts located in Travis County, Texas.

For users located outside the United States, mandatory consumer-protection laws of your country of residence may override the choice of law and forum above to the extent required by law. Nothing in these Terms is intended to deprive a consumer of rights that cannot be waived under such mandatory local law.

19. Binding Arbitration, Class-Action Waiver, and Jury-Trial Waiver

To the maximum extent permitted by applicable law, you and JoGo.Team agree that any dispute, claim, or controversy arising out of or relating to the Platform or these Terms shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Travis County, Texas (or by remote/online proceeding where the AAA permits).

You and JoGo.Team each waive any right to bring, participate in, or recover from any class action, collective action, mass action, or representative proceeding. You and JoGo.Team each waive any right to a trial by jury. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual-property infringement or to enforce an arbitration award.

You may opt out of this arbitration provision within 30 days of first creating a JoGo.Team account by sending written notice through the contact form on the Platform; opting out does not affect any other provision of these Terms. If the class-action waiver is found unenforceable as to any particular claim, that claim shall be litigated in court on an individual basis, and the remainder of this section shall remain in arbitration.

20. Severability and Survival

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Sections 13 (Warranties), 14 (Limitation of Liability), 15 (Indemnification), 18 (Governing Law), 19 (Arbitration), and 20 (Severability) survive any termination of your account or use of the Platform.
